Terms of Service & EULA
Last updated: June 2026 | Effective for HamMixer v1.25.0 and later
1 Acceptance of Terms
By downloading, installing, or using HamMixer ("the Software"), you agree to be bound by this End-User License Agreement ("EULA") and Terms of Service. If you do not agree to these terms, do not install or use the Software.
This agreement constitutes a legally binding contract between you ("the User") and CT7BAC ("the Developer"), the sole creator and rights holder of HamMixer.
2 Definitions
- "Software" refers to HamMixer Desktop (Windows client), HamMixer Server (Windows server), and HamMixer Mobile (Android app), collectively or individually.
- "Registration" refers to the one-time, free in-app submission of your name, callsign, and email address, used only to send occasional update news.
- "Services" refers to the update server and any related online infrastructure operated by the Developer at ct7bac.com.
3 License Grant
Subject to compliance with these terms, the Developer grants you a free, non-exclusive, revocable license to install and use the Software for personal, non-commercial amateur-radio use. There is no time limit on this license. Commercial use requires separate written permission from the Developer.
You may install the Software on your own devices for personal use. You may not sell, sublicense, rent, lease, or otherwise distribute the Software to any third party, nor use it for commercial purposes, without prior written permission from the Developer.
4 Cost & Registration
HamMixer is provided free of charge for personal, non-commercial amateur-radio use. There is no purchase, no subscription, and no license key required, and you may install it on your own devices.
On first launch, the Software asks for a one-time free registration (name, callsign, and email address) so the Developer knows who is using HamMixer. This registration is performed inside the application and does not involve any payment.
The HamMixer Desktop client, HamMixer Server, and HamMixer Mobile app are all free. The Mobile app requires HamMixer Server to function.
5 Free Use & Devices
HamMixer is free to use with no license key, no activation, and no device limit. You may install and run the Software on as many of your own machines as you like for personal, non-commercial amateur-radio use.
No machine binding: The Software does not generate any hardware fingerprint, bind to a specific machine, or contact an activation server in order to run. There is nothing to activate, deactivate, or transfer between devices.
This free use is granted for personal, non-commercial amateur-radio use. Commercial use requires separate written permission from the Developer.
6 Registration & Update News
On first launch, the HamMixer Desktop and Server applications ask for a one-time free registration consisting of your name, callsign, and email address. This registration involves no payment, no license key, and no machine binding.
The registration details are used solely to send you occasional news about updates. You may contact the Developer at ct7bac@gmail.com at any time to update or remove your registration details.
For full details on how this data is handled, see our Privacy Policy.
7 Free License
The Software is provided free of charge for personal, non-commercial amateur-radio use, with no time limit. All features are available at no cost — there is nothing to purchase and no license key to buy.
Commercial use requires separate written permission from the Developer. If you wish to use HamMixer in a commercial context, contact the Developer at ct7bac@gmail.com.
8 Updates & Support
All updates are free. All future versions, features, and improvements are provided at no cost. The Software includes a free in-app update checker that periodically checks the Developer's update server for new versions. Updates are optional and never forced.
Support is provided on a best-effort basis via email. The Developer is under no obligation to provide guaranteed response times, custom modifications, or dedicated support channels.
The Software performs no license validation and does not require contact with any server in order to run. If the update server is unavailable, the Software continues to operate normally.
9 Intellectual Property
All rights reserved. HamMixer, including its source code, binaries, user interface, documentation, graphics, logos, and related materials, is the exclusive intellectual property of CT7BAC.
This license does not grant you any ownership rights in the Software. You may not:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software.
- Modify, adapt, translate, or create derivative works based on the Software.
- Copy, distribute, or make the Software available to third parties, except as expressly permitted by this agreement.
- Remove, alter, or obscure any copyright notices, trademarks, or proprietary markings.
- Use the HamMixer name, logo, or branding for any purpose without prior written consent.
10 Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The Developer does not warrant that:
- The Software will meet your specific requirements or expectations.
- The Software will operate uninterrupted, error-free, or free of harmful components.
- The Software will be compatible with all hardware configurations, radio equipment, or third-party software.
- Any defects or errors in the Software will be corrected within any specific timeframe.
- The update server will be available at all times.
You acknowledge that amateur radio operation involves inherent risks, and you assume full responsibility for the use of the Software in conjunction with your radio equipment.
11 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CT7BAC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, revenue, profits, or business opportunities.
- Damage to radio equipment, computers, or other hardware.
- Interruption of radio communications or station operations.
- Cost of procurement of substitute goods or services.
- Any damages arising from unauthorized access to or alteration of your transmissions or data.
Because the Software is provided to you free of charge, the Developer's total cumulative liability under this agreement shall not exceed ten euros (€10). This limitation applies regardless of the legal theory upon which the claim is based, whether in contract, tort, strict liability, or otherwise.
12 Termination
This license is effective until terminated. It will terminate automatically if you fail to comply with any term of this agreement. The Developer reserves the right to revoke your right to use the Software in cases of:
- Violation of any provision of this EULA.
- Redistributing, reselling, or otherwise making the Software available to third parties without prior written permission.
- Attempts to reverse engineer, modify, or tamper with the Software.
- Use of the Software for any unlawful purpose.
Upon termination, you must cease all use of the Software and destroy all copies in your possession. Sections 9, 10, 11, and 14 shall survive termination.
13 Privacy
The Software collects and transmits the following data to the Developer's servers:
- Registration details (name, callsign, and email address) provided once at first launch, used only to send occasional update news.
- Software version for update checks.
- IP address (logged transiently for security and rate-limiting purposes).
No radio communications, audio data, or usage telemetry is collected. For full details, see our Privacy Policy.
14 Governing Law
This agreement shall be governed by and construed in accordance with the laws of Portugal. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of Portugal.
15 Changes to Terms
The Developer reserves the right to modify these terms at any time. Updated terms will be posted on this page with a revised "Last updated" date. Continued use of the Software after changes are posted constitutes acceptance of the revised terms.
For material changes that significantly affect your rights, the Developer will make reasonable efforts to notify users through the Software's update mechanism or via the website.
