Terms of Service & EULA

1 Acceptance of Terms

By downloading, installing, or using HamMixer ("the Software"), you agree to be bound by this End-User License Agreement ("EULA") and Terms of Service. If you do not agree to these terms, do not install or use the Software.

This agreement constitutes a legally binding contract between you ("the User") and CT7BAC ("the Developer"), the sole creator and rights holder of HamMixer.

2 Definitions

3 License Grant

Subject to compliance with these terms, the Developer grants you a perpetual, non-exclusive, non-transferable, revocable license to install and use the Software on the permitted number of machines for personal, non-commercial ham radio use.

This license is per-machine. Each installation must be activated with a valid License Key bound to the machine's hardware fingerprint. You may not share, sublicense, rent, lease, or otherwise distribute your License Key to any third party.

4 Activation Limits

Each License Key permits a limited number of concurrent activations based on the license tier purchased:

Exceeding these limits will require deactivating an existing machine before activating a new one. The HamMixer Mobile app is free to download but requires HamMixer Server (included in the Full Bundle) to function.

5 Hardware Fingerprint & Tolerance

The Software generates a hardware fingerprint from three system components: CPU ID, motherboard serial number, and BIOS serial number. This fingerprint is used to bind activations to specific machines.

Hardware change tolerance: The activation system allows 1 hardware component change without requiring reactivation. This accommodates typical hardware upgrades (e.g., replacing a CPU or motherboard). If 2 or more components change simultaneously, you must deactivate and reactivate your license.

The fingerprint data is transmitted securely to the activation server and is used solely for license validation purposes. It is not shared with any third parties.

6 Deactivation & Transfer

You may deactivate a license from a machine at any time through the Software's License dialog. Deactivation frees the activation slot, allowing you to activate the Software on a different machine.

To deactivate:

  1. Open HamMixer on the machine you wish to deactivate.
  2. Navigate to the License dialog.
  3. Click "Deactivate" to release the activation.
  4. Activate the Software on your new machine using the same License Key.

If you no longer have access to a previously activated machine (e.g., hardware failure, theft), contact the Developer at ct7bac@gmail.com with your License Key and a description of the situation. Activation slots may be manually released at the Developer's discretion.

License Keys are non-transferable. You may not sell, give away, or transfer your License Key to another person.

7 Free Trial

The Software includes a 14-day free trial with full functionality. The trial begins upon first launch and requires no License Key, credit card, or registration.

The trial provides complete, unrestricted access to all features of the Software so you can fully evaluate it before purchasing. Upon expiration, the Software will cease to function until a valid License Key is entered.

The trial period cannot be extended, reset, or restarted.

8 Refund Policy

All purchases are final. No refunds will be issued.

The 14-day free trial with full functionality serves as your evaluation period. You are encouraged to thoroughly test the Software during the trial to ensure it meets your needs before purchasing a License Key.

By purchasing a License Key, you acknowledge that you have had adequate opportunity to evaluate the Software and that you accept this no-refund policy.

9 Updates & Support

Your license includes free updates for life. All future versions, features, and improvements are included at no additional cost. The Software periodically checks for updates via the Developer's server.

Support is provided on a best-effort basis via email. The Developer is under no obligation to provide guaranteed response times, custom modifications, or dedicated support channels.

If the license validation server becomes permanently unavailable, the Software includes a 45-day grace period during which it will continue to operate normally without server contact.

10 Intellectual Property

All rights reserved. HamMixer, including its source code, binaries, user interface, documentation, graphics, logos, and related materials, is the exclusive intellectual property of CT7BAC.

This license does not grant you any ownership rights in the Software. You may not:

11 Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Developer does not warrant that:

You acknowledge that amateur radio operation involves inherent risks, and you assume full responsibility for the use of the Software in conjunction with your radio equipment.

12 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CT7BAC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

The Developer's total cumulative liability under this agreement shall not exceed the amount you paid for the License Key. This limitation applies regardless of the legal theory upon which the claim is based, whether in contract, tort, strict liability, or otherwise.

13 Termination

This license is effective until terminated. It will terminate automatically if you fail to comply with any term of this agreement. The Developer reserves the right to revoke License Keys in cases of:

Upon termination, you must cease all use of the Software and destroy all copies in your possession. Sections 8, 10, 11, 12, and 15 shall survive termination.

14 Privacy

The Software collects and transmits the following data to the Developer's servers:

No personal information, radio communications, audio data, or usage telemetry is collected. For full details, see our Privacy Policy.

15 Governing Law

This agreement shall be governed by and construed in accordance with the laws of Portugal. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of Portugal.

16 Changes to Terms

The Developer reserves the right to modify these terms at any time. Updated terms will be posted on this page with a revised "Last updated" date. Continued use of the Software after changes are posted constitutes acceptance of the revised terms.

For material changes that significantly affect your rights, the Developer will make reasonable efforts to notify users through the Software's update mechanism or via the website.
